SKOPJE (Macedonia), November 8 (SeeNews) – The Secretariat of the Energy Community (EnC) said it will request that the Ministerial Council vote on a proposal to suspend Macedonia’s rights, deriving from the EnC Treaty, due to the country’s failure to transpose the Third Energy Package.
On October 14, the Ministerial Council adopted a decision which stated that Macedonia had failed to comply with its obligations to transpose the Third Energy Package, the EnC Secretariat said in its annual implementation report published on Monday.
“Since the breach has not been rectified to date, the Secretariat – as invited by the Ministerial Council - will request a decision under Article 92 of the Treaty at its next meeting in 2017,” the report reads.
Under the procedure, the Ministerial Council, acting by unanimity, may determine the existence of a serious and persistent breach by Macedonia of its obligations under the Treaty establishing Energy Community and may suspend certain rights deriving from application of the treaty, including the suspension of voting rights and exclusion from meetings or mechanisms provided for in the treaty.
The decision to suspend Macedonia’s rights can be subsequently revoked by a Ministerial Council decision by simple majority.
The Energy Community is an international organisation consisting of the EU, represented by the European Commission, and the countries of Albania, Bosnia and Herzegovina, Georgia, Macedonia, Kosovo, Moldova, Montenegro, Serbia and Ukraine.
