March 13 (SeeNews) - Slovenia's administrative court has overturned a 2015 decision by the competition watchdog regarding Telekom Slovenije's [LJE:TLSG] abuse of dominant position on the markets for broadband bitstream access and access to physical network infrastructure, the company said.
The administrative court ruled fully in favour of Telekom Slovenije, completely reversing the competition regulator's decision, Telekom Slovenije said in a bourse filing on Tuesday.
In February 2015, Slovenia's competition protection agency determined that Telekom Slovenije abused its dominant position on the markets for broadband bitstream access and access to physical network infrastructure by using a unified complex business practice in the period from January 1, 2005 until at least March 14, 2014.
In 2015, the competition regulator stated that Telekom Slovenije denied alternative operators access to DSLAMs, xDSL service, and fiber optics in areas lacking copper infrastructure. Additionally, the company reportedly prohibited the sale of its broadband bitstream access services to third-party operators in unbundled loops.
In 2018, the Slovenian administrative court partially upheld Telekom Slovenije's appeal against the regulator's decision, clearing the allegations of abuse of dominant position up until September 2008. In 2021, Slovenia's supreme court returned the lawsuit to the administrative court of first appeal for further review.
